Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.
Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf yr Amgylchedd Hanesyddol (Cymru) 2023, Croes Bennawd: Penderfynu ceisiadau am gydsyniad heneb gofrestredig.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
Rhagolygol
(1)Caiff Gweinidogion Cymru roi cydsyniad heneb gofrestredig mewn cysylltiad â’r holl waith neu unrhyw ran o’r gwaith y mae cais yn ymwneud ag ef.
(2)Cyn penderfynu pa un ai i roi cydsyniad heneb gofrestredig ar gais, caiff Gweinidogion Cymru wneud un neu ragor o’r canlynol—
(a)peri i ymchwiliad lleol gael ei gynnal,
(b)rhoi cyfle i’r ceisydd, ac unrhyw berson arall, i ymddangos gerbron person a benodir gan Weinidogion Cymru a chael gwrandawiad ganddo, neu
(c)rhoi cyfle i’r ceisydd, ac unrhyw berson arall, i gyflwyno sylwadau ysgrifenedig i berson a benodir gan Weinidogion Cymru.
(3)Cyn penderfynu pa un ai i roi cydsyniad heneb gofrestredig ar gais, rhaid i Weinidogion Cymru—
(a)ym mhob achos, ystyried unrhyw sylwadau a gyflwynir gan unrhyw berson mewn cysylltiad â’r cais hwnnw, a
(b)os cynhaliwyd ymchwiliad neu wrandawiad neu os cyflwynwyd sylwadau yn unol ag is-adran (2)(c), ystyried adroddiad y person a gynhaliodd yr ymchwiliad neu’r gwrandawiad neu y cyflwynwyd y sylwadau iddo.
(4)Rhaid i Weinidogion Cymru gyflwyno hysbysiad o’u penderfyniad mewn cysylltiad â’r cais i’r ceisydd ac i bob person sydd wedi cyflwyno sylwadau mewn cysylltiad â’r cais.
(5)Mae cydsyniad heneb gofrestredig yn cael effaith er budd yr heneb a phob person sydd â buddiant yn yr heneb am y tro; ond mae hyn yn ddarostyngedig i delerau’r cydsyniad.
(6)Mae Atodlen 6 yn gymwys mewn perthynas ag achosion a gynhelir o dan is-adran (2).
