Mae’r fersiwn hon o'r ddarpariaeth hon yn rhagolygol.
Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:
Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.
Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf yr Amgylchedd Hanesyddol (Cymru) 2023, Adran 95.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
Rhagolygol
(1)Ni chaiff awdurdod cynllunio y gwneir cais am gydsyniad adeilad rhestredig iddo roi cydsyniad oni bai—
(a)ei fod wedi hysbysu Gweinidogion Cymru am y cais, gan roi manylion y gwaith y ceisir cydsyniad ar ei gyfer, a
(b)bod yr amod cyntaf neu’r ail amod wedi ei fodloni.
(2)Yr amod cyntaf yw bod yr 28 o ddiwrnodau sy’n dechrau â’r diwrnod yr hysbyswyd Gweinidogion Cymru wedi dod i ben heb i Weinidogion Cymru naill ai—
(a)cyfarwyddo’r awdurdod i atgyfeirio’r cais atynt o dan adran 94, neu
(b)hysbysu’r awdurdod bod angen rhagor o amser arnynt i ystyried pa un ai i roi cyfarwyddyd o dan yr adran honno.
(3)Yr ail amod yw bod Gweinidogion Cymru wedi hysbysu’r awdurdod nad ydynt yn bwriadu ei gyfarwyddo i atgyfeirio’r cais atynt.
(4)Caiff Gweinidogion Cymru drwy reoliadau ddarparu nad yw is-adran (1) yn gymwys i geisiadau am gydsyniad adeilad rhestredig sydd o ddisgrifiad a bennir yn y rheoliadau.
(5)Caiff Gweinidogion Cymru gyfarwyddo awdurdod cynllunio—
(a)nad yw is-adran (1) i fod yn gymwys i gais i’r awdurdod am gydsyniad adeilad rhestredig, neu
(b)bod is-adran (1) i fod yn gymwys i gais i’r awdurdod er gwaethaf unrhyw ddarpariaeth a wneir gan reoliadau o dan is-adran (4) neu gan gyfarwyddyd o dan baragraff (a).
(6)Caiff cyfarwyddyd ymwneud—
(a)â chais penodol am gydsyniad adeilad rhestredig, neu
(b)â cheisiadau sydd o ddisgrifiad a bennir yn y cyfarwyddyd,
ac mae’n cael effaith mewn perthynas ag unrhyw gais nad yw’r awdurdod wedi ei benderfynu.
(7)Caiff Gweinidogion Cymru bennu disgrifiad o geisiadau o dan is-adran (4) neu (6)(b) drwy gyfeirio at farn unrhyw berson, argaeledd cyngor arbenigol mewn perthynas â’r ceisiadau, neu unrhyw amgylchiad arall.
