Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. (1)Caiff ceisydd sydd wedi gofyn am adolygiad o dan adran 85 apelio i’r llys sirol ar unrhyw bwynt cyfreithiol sy’n codi o’r penderfyniad neu, yn ôl y digwydd, y penderfyniad gwreiddiol neu gwestiwn ynghylch a gymerwyd pob cam rhesymol—

(a)os yw’r ceisydd yn anfodlon â’r penderfyniad yn yr adolygiad, neu

(b)os nad yw’r ceisydd yn cael ei hysbysu am y penderfyniad yn yr adolygiad o fewn y cyfnod a ragnodir o dan adran 86.

(2)Rhaid cyflwyno apêl o fewn 21 o ddiwrnodau i hysbysu’r ceisydd am y penderfyniad neu, yn ôl y digwydd, i’r diwrnod y dylai’r ceisydd fod wedi cael ei hysbysu am benderfyniad mewn adolygiad.

(3)Caiff y llys ganiatáu cyflwyno apêl ar ôl diwedd y cyfnod a ganiateir gan is-adran (2), ond dim ond os yw’n fodlon—

(a)pan ofynnir am ganiatâd cyn diwedd y cyfnod hwnnw, bod rheswm da pam nad yw’r ceisydd yn gallu cyflwyno’r apêl mewn pryd, neu

(b)pan ofynnir am ganiatâd ar ôl y cyfnod hwnnw, bod rheswm da dros fethiant y ceisydd i gyflwyno’r apêl mewn pryd ac am unrhyw oedi cyn gwneud cais am ganiatâd.

(4)Mewn apêl caiff y llys wneud y cyfryw orchymyn i gadarnhau, i ddiddymu neu i amrywio’r penderfyniad ag y gwêl yn dda.

(5)Pan oedd yr awdurdod o dan ddyletswydd o dan adran 68, 75 neu 82 i sicrhau bod llety addas ar gael i’r ceisydd ei feddiannu, caiff sicrhau bod llety addas ar gael yn y fath fodd—

(a)yn ystod y cyfnod ar gyfer apelio o dan yr adran hon yn erbyn penderfyniad yr awdurdod, a

(b)os cyflwynir apêl, hyd nes y penderfynir yn derfynol ar yr apêl (ac unrhyw apêl bellach).
