F2 If, with intent to deceive, any person—
(a)F3. . . alters or uses or lends to, or allows to be used by, any other person, a licence granted under Part II F4... [F5 or any certificate or diploma referred to in[F6 section 46D(1)F4 ...]]F4 ...[F7 or a control document issued under Article 6 of Council Regulation (EC) No. 12/98 of 11th December 1997];
(b)makes or has in his possession any document F8... so closely resembling any such licence [F5, certificate, diploma] [F9or control document] as to be calculated to deceive;
he shall be guilty of an offence and shall be liable —
on summary conviction, to a fine not exceeding[F10 level 3 on the standard scale] or to imprisonment for a term not exceeding six months, or to both such fine and such imprisonment;
on conviction on indictment, to imprisonment for a term not exceeding two years, with or without a fine.
