Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.

30Dod yn gyngor cymuned cymwysLL+C

(1)Caiff cyngor cymuned sy’n bodloni pob un o’r amodau a nodir yn is-adrannau (2) i (4) (“yr amodau cymhwystra”) ddod yn gyngor cymuned cymwys at ddibenion Pennod 1 drwy basio penderfyniad, mewn unrhyw gyfarfod o’r cyngor, ei fod yn gyngor cymuned cymwys.

(2)Yr amod cyntaf yw y datganwyd bod o leiaf ddau draean o gyfanswm cynghorwyr y cyngor cymuned wedi eu hethol (boed mewn etholiad cyffredin neu mewn is-etholiad).

(3)Yr ail amod yw bod clerc y cyngor yn dal cymhwyster neu ddisgrifiad o gymhwyster o fath a bennir gan Weinidogion Cymru drwy reoliadau.

(4)Y trydydd amod yw—

(a)bod barn ddiweddaraf Archwilydd Cyffredinol Cymru ar gyfrifon y cyngor—

(i)yn farn ddiamod gan Archwilydd Cyffredinol Cymru, a

(ii)yn farn y mae’r cyngor wedi ei chael yn ystod y cyfnod o 12 mis sy’n dod i ben ar y diwrnod y bydd y cyngor (os yw’n pasio penderfyniad yn unol ag is-adran (1)) yn dod yn gyngor cymuned cymwys, a

(b)bod barn Archwilydd Cyffredinol Cymru ar gyfrifon y cyngor a oedd yn union ragflaenu’r farn a grybwyllir ym mharagraff (a) hefyd yn farn ddiamod gan Archwilydd Cyffredinol Cymru.

(5)At ddibenion is-adran (4) ac adran 34—

(a)ystyr barn Archwilydd Cyffredinol Cymru yw barn a ddarperir gan Archwilydd Cyffredinol Cymru o dan adran 23 o Ddeddf Archwilio Cyhoeddus (Cymru) 2004 (p. 23), ar ôl cynnal archwiliad o gyfrifon cyngor cymuned ar gyfer blwyddyn ariannol, a

(b)mae barn Archwilydd Cyffredinol Cymru yn farn ddiamod os nad yw Archwilydd Cyffredinol Cymru, yn y farn, wedi datgan mewn unrhyw fodd nad yw’n fodlon o ran y materion a nodir yn adran 17 o Ddeddf Archwilio Cyhoeddus (Cymru) 2004.

(6)Mae cyngor cymuned sy’n pasio penderfyniad yn unol ag is-adran (1) yn dod yn gyngor cymuned cymwys pan fo’n pasio’r penderfyniad.
