Orders relating to commercially damaging species
14Offences relating to persons appointed under section 13
(1)
A person commits an offence if the person—
(a)
fails to comply with a requirement imposed by a person appointed by virtue of subsection (1)(a) or (3)(b) of section 13, or
(b)
wilfully obstructs such a person in the exercise of a power conferred by an order under section 12(1).
(2)
It is a defence for a person charged with an offence under subsection (1)(a) to show that the person had a reasonable excuse for the failure.
(3)
A person who commits an offence under subsection (1)(a) is liable on summary conviction to a fine not exceeding level 5 on the standard scale.
(4)
A person who commits an offence under subsection (1)(b) is liable—
(a)
on summary conviction, to a fine not exceeding the statutory maximum, and
(b)
on conviction on indictment, to a fine.
