The Scottish Ministers, in exercise of the powers conferred by section 59(2) of the Planning etc. (Scotland) Act 2006(1) hereby make the following Order:
1. This Order may be cited as the Planning etc. (Scotland) Act 2006 (Commencement No. 1) Order 2007.
2. The provisions of the Planning etc. (Scotland) Act 2006 which are specified in column 1 of the Schedule to this Order (and the subject matter of which is described in column 2 of that Schedule) shall come into force on 6th February 2007 but, where a particular purpose is specified in relation to any provision in column 3 of that Schedule, that provision shall come into force on that day only for that purpose.

This Order brings into force on 6th February 2007 section 3 and Part 9 of the Planning etc. (Scotland) Act 2006 (“the Act”) for the limited purposes of enabling the Scottish Ministers to make, or to make provision by means of, subordinate legislation.
The Order also brings into force on 6th February 2007 sections 57 and 58 of the Act for all purposes and section 54 for the limited purpose of amending section 275 of the Town and Country Planning (Scotland) Act 1997 (c. 8) by section 54(16)(a).
The Act received Royal Assent on 20th December 2006. Sections 59 and 60 came into force on Royal Assent.
