HOUSING, SCOTLAND

The Housing Support Grant (Scotland) Variation Order 1988

The Secretary of State, in exercise of the powers conferred on him by sections 191, 192 and 193 of the Housing (Scotland) Act 1987 (1), and of all other powers enabling him in that behalf, since it appears to him that after the time when the amount mentioned in section 191(2) of the said Act was estimated for 1987-88 the eligible expenditure of local authorities for that year has been substantially decreased by reason of changes which have taken place in the level of the matters specified in section 191(3)(b) of the said Act, and that account was not taken of those changes when the amount mentioned as aforesaid was estimated, and after such consultation with such associations of local authorities as appear to him to be concerned as is required by the said sections 191, 192 and 193, and with the consent of the Treasury, hereby makes the following Order, a draft of which has been approved by the House of Commons:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Housing Support Grant (Scotland) Variation Order 1988 and shall come into force forthwith.

(2) In this order “the Order of 1987” means the Housing Support Grant (Scotland) Order 1987 (2).

(3) Unless the context otherwise requires, expressions used in this Order shall have the same meaning as in the Order of 1987.

Aggregate grant for 1987-88

2.  For the aggregate amount of housing support grants and the general and hostel portions thereof fixed for the year 1987-88 by articles 2 and 3 of the Order of 1987 (as indicated in parenthesis in the second column of the following table) there shall be substituted the amount and portions set out in the third column thereof:—

Apportionment of housing support grants for 1987-88

3.—(1) The general portion of housing support grants shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures assessed in the manner provided in the Schedule to the Order of 1987.

(2) The hostel portion shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures for the year 1987-88 on the provision of hostels and lodging houses.

Explanatory Note

This Order in relation to the year 1987-88 decreases the aggregate amount of housing support grants and the portions thereof payable to certain local authorities in Scotland.
