The disclosures shall be published following a common format and updated regularly. The disclosures shall be accessible at a single electronic location.</p></content></paragraph><paragraph eId="article-143-3"><num>3</num><content><p>EBA shall develop draft implementing technical standards to determine the format, structure, contents list and annual publication date of the information listed in paragraph 1.</p><p>EBA shall submit those draft implementing technical standards to the Commission by 1 January 2014.</p><p>Power is conferred on the Commission to adopt the implementing technical standards referred to in the first subparagraph in accordance with Article 15 of Regulation (EU) No 1093/2010.</p></content></paragraph></article><article eId="article-144" period="#period1"><num>Article 144</num><heading>Specific disclosure requirements</heading><paragraph eId="article-144-1"><num>1</num><intro><p>For the purpose of Part Five of Regulation (EU) No 575/2013, competent authorities shall publish the following information:</p></intro><subparagraph eId="d4e693"><num>a</num><content><p>the general criteria and methodologies adopted to review compliance with Articles 405 to 409 of Regulation (EU) No 575/2013;</p></content></subparagraph><subparagraph eId="d4e699"><num>b</num><content><p>without prejudice to the provisions laid down in Title VII, Chapter 1, Section II, a summary description of the outcome of the supervisory review and description of the measures imposed in cases of non-compliance with Articles 405 to 409 of Regulation (EU) No 575/2013, identified on an annual basis.</p></content></subparagraph></paragraph><paragraph eId="article-144-2"><num>2</num><intro><p>The competent authority of a Member State exercising the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013 shall publish the following information:</p></intro><subparagraph eId="d4e711"><num>a</num><content><p>the criteria it applies to determine that there is no current or foreseen material practical or legal impediment to the prompt transfer of own funds or repayment of liabilities;</p></content></subparagraph><subparagraph eId="d4e717"><num>b</num><content><p>the number of parent institutions which benefit from the exercise of the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013 and the number of those which incorporate subsidiaries in a third country;</p></content></subparagraph><subparagraph eId="d4e723"><num>c</num><content><p>on an aggregate basis for the Member State:</p><blockList class="ordered"><item><num>(i)</num><p>the total amount of own funds on the consolidated basis of the parent institution in a Member State, which benefits from the exercise of the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013, which are held in subsidiaries in a third country;</p></item><item><num>(ii)</num><p>the percentage of total own funds on the consolidated basis of parent institutions in a Member State which benefits from the exercise of the discretion laid down in Article 7(3) of that Regulation, represented by own funds which are held in subsidiaries in a third country;</p></item><item><num>(iii)</num><p>the percentage of total own funds required under Article 92 of that Regulation on the consolidated basis of parent institutions in a Member State, which benefits from the exercise of the discretion laid down in Article 7(3) of that Regulation, represented by own funds which are held in subsidiaries in a third country.</p></item></blockList></content></subparagraph></paragraph><paragraph eId="article-144-3"><num>3</num><intro><p>The competent authority which exercises the discretion laid down in Article 9(1) of Regulation (EU) No 575/2013 shall publish all the following:</p></intro><subparagraph eId="d4e749"><num>a</num><content><p>the criteria it applies to determine that there is no current or foreseen material practical or legal impediment to the prompt <p>For the purpose of Part Five of Regulation (EU) No 575/2013, competent authorities shall publish the following information:</p>

<num>a</num>
<content>
<p>the general criteria and methodologies adopted to review compliance with Articles 405 to 409 of Regulation (EU) No 575/2013;</p>
</content>
</subparagraph>
<subparagraph eId="d4e699">
<num>b</num>
<content>
<p>without prejudice to the provisions laid down in Title VII, Chapter 1, Section II, a summary description of the outcome of the supervisory review and description of the measures imposed in cases of non-compliance with Articles 405 to 409 of Regulation (EU) No 575/2013, identified on an annual basis.</p>

<paragraph eId="article-144-2">
<num>2</num>
<intro>
<p>The competent authority of a Member State exercising the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013 shall publish the following information:</p>
</intro>
<subparagraph eId="d4e711">
<num>a</num>
<content>
<p>the criteria it applies to determine that there is no current or foreseen material practical or legal impediment to the prompt transfer of own funds or repayment of liabilities;</p>
</content>
</subparagraph>
<subparagraph eId="d4e717">
<num>b</num>
<content>
<p>the number of parent institutions which benefit from the exercise of the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013 and the number of those which incorporate subsidiaries in a third country;</p>
</content>
</subparagraph>
<subparagraph eId="d4e723">
<num>c</num>
<content>
<p>on an aggregate basis for the Member State:</p>

<num>(i)</num>
<p>the total amount of own funds on the consolidated basis of the parent institution in a Member State, which benefits from the exercise of the discretion laid down in Article 7(3) of Regulation (EU) No 575/2013, which are held in subsidiaries in a third country;</p>
</item>
<item>
<num>(ii)</num>
<p>the percentage of total own funds on the consolidated basis of parent institutions in a Member State which benefits from the exercise of the discretion laid down in Article 7(3) of that Regulation, represented by own funds which are held in subsidiaries in a third country;</p>
</item>
<item>
<num>(iii)</num>
<p>the percentage of total own funds required under Article 92 of that Regulation on the consolidated basis of parent institutions in a Member State, which benefits from the exercise of the discretion laid down in Article 7(3) of that Regulation, represented by own funds which are held in subsidiaries in a third country.</p>

<p>The competent authority which exercises the discretion laid down in Article 9(1) of Regulation (EU) No 575/2013 shall publish all the following:</p>

<num>a</num>
<content>
<p>the criteria it applies to determine that there is no current or foreseen material practical or legal impediment to the prompt transfer of own funds or repayment of liabilities;</p>

<p>the percentage of total own funds of parent institutions which benefit from the exercise of the discretion laid down in Article 9(1) of Regulation (EU) No 575/2013 represented by own funds which are held in subsidiaries in a third country;</p>

<item>
<num>(iii)</num>
<p>the percentage of total own funds required under Article 92 of Regulation (EU) No 575/2013 of parent institutions which benefit from the exercise of the discretion laid down in Article 9(1) of that Regulation represented by own funds which are held in subsidiaries in a third country.</p>
