42SIn section 259 (exceptions to the rule that hearsay evidence is inadmissible)—

(a)in subsection (5), for “before the trial diet” substitute “ by the relevant time ”,

(b)after that subsection insert—

(5A)In subsection (5) above, “the relevant time” means—

(a)in the case of proceedings in the High Court—

(i)not less than 7 days before the preliminary hearing; or

(ii)such later time, before the trial diet, as the judge may on cause shown allow;

(b)in any other case, before the trial diet..
