Commencement

2.—(1) Sections 37(2) and (9), 39(3) and 41(d) of the Adults with Incapacity (Scotland) Act 2000 shall come into force on 6th March 2003 but only for the purpose of making regulations to come into force on 1st April 2003.

(2) The following provisions of the Adults with Incapacity (Scotland) Act 2000 shall come into force on 1st April 2003:–

(a)Part 4 (Management of Residents' Finances) insofar as not already in force;

(b)Schedule 1 (Managers of an Establishment);

(c)Section 88(1) and schedule 4 but only for the purpose of bringing paragraph 5 of that schedule into force;

(d)Section 88(2) and schedule 5 (minor and consequential amendments) but only for the purpose of bringing paragraph 17(23) of that schedule into force; and

(e)Section 88(3) and schedule 6 (repeals) but only for the purpose of bringing into force the repeal in section 5(2) and of section 94 of the Mental Health (Scotland) Act 1984(1).
