Application of enactments governing procedure in proceedings brought on complaint

16.  –

(1) Section 53(3) of the Magistrates' Courts Act 1980(1) (orders with the consent of the defendant without hearing evidence) shall apply to applications under section 20 of the Act for the variation of orders for periodical payments, as it applies to complaints for the variation of the rate of any periodical payments ordered by a magistrates' court to be made.

(2) Section 97 of the Magistrates' Courts Act 1980 (issue of a witness summons) shall apply to proceedings under the Act as it applies to a hearing of a complaint under that section.
