Amendment of regulation 8

2.  In regulation 8 of the Social Security (Overlapping Benefits) Regulations 1979 (child benefit)(1)–

(a)in paragraph (3) for the words “paragraphs (4) and (5)” there shall be substituted the words “paragraphs (4), (5) and (6).”;

(b)for paragraph (5) there shall be substituted the following paragraph–

(5) For the purposes of paragraph (3), the sum of £0.75 shall be deducted from the amount by which the child benefit payable exceeds the amount of child benefit which would have been payable had the child not been the only, the elder, or eldest child;.

(c)after paragraph (5) there shall be added the following paragraph–

(6) Where the weekly rate of any benefit or increase of benefit under the Act or the weekly rate of child benefit or both are increased in consequence of an order under section 63(2) of the Social Security Act 1986(2)and as a result the amount by which the benefit being adjusted under paragraph (3) changes, the weekly rate of benefit or increase shall not be reduced by the increased amount until the date on which the change in that benefit or increase of benefit has effect..
