Saving and transitory provisions

3.—(1) Section 95 of the 2008 Act comes into force for the purposes of requiring the Secretary of State to keep a register of independent educational institutions within the meaning of section 92(1)(a) of the 2008 Act(1).

(2) A reference to an independent educational institution in Chapter 1 of Part 4 of the 2008 Act is to be construed as a reference to an independent educational institution within the meaning of section 92(1)(a) of the 2008 Act.

(3) The instruments listed in column (1) of the Schedule are revoked to the extent specified in column (3).

An independent educational institution within the meaning of section 92(1)(a) is an independent school – see section 463 of the Education Act 1996 (c. 56). Section 463 was substituted by section 172 of the Education Act 2002. Section 463 was amended by section 82 and paragraphs 1 and 43(a) and (b) of Part 1 of Schedule 3 to the Children and Families Act 2014 and article 5(1) and paragraph 7(1) and (2) of Part 1 to Schedule 2 to the Local Education Authorities and Children’s Services Authorities (Integration of Functions) Order 2010 (S.I. 2010/1158).
