1LL+CRhaid i Bartïon Gwladwriaethau sicrhau na chaiff plentyn ei wahanu oddi wrth ei rieni yn erbyn eu hewyllys, ac eithrio pan fo awdurdodau cymwys, yn ddarostyngedig i adolygiad barnwrol, yn penderfynu, yn unol â'r gyfraith a'r gweithdrefnau sy'n gymwysadwy, fod angen y gwahanu hwnnw er lles pennaf y plentyn. Gall penderfyniad o'r fath fod yn angenrheidiol mewn achos penodol megis un sy'n golygu bod y plentyn yn cael ei cam-drin neu ei esgeuluso gan y rhieni, neu un lle mae'r rhieni'n byw ar wahân a bod rhaid gwneud penderfyniad ynghylch preswylfan y plentyn.

4LL+CPan fo'r gwahanu hwnnw yn ganlyniad i unrhyw gamau a gychwynnwyd gan Barti Gwladwriaeth, megis cadwad, carchariad, alltudiaeth, allgludiad neu farwolaeth (gan gynnwys marwolaeth sy'n deillio o unrhyw achos tra bo'r person yn nalfa'r Wladwriaeth) un rhiant neu'r ddau ohonynt neu'r plentyn, rhaid i'r Parti Gwladwriaeth, ar archiad, ddarparu i'r rhieni, y plentyn neu, os yw'n briodol, aelod arall o'r teulu yr wybodaeth hanfodol ynghylch lleoliad aelod(au) absennol y teulu oni fyddai darparu'r wybodaeth yn niweidiol i lesiant y plentyn.
