3Dyletswydd corff addysg i gydlafurio

(1)Rhaid i gorff addysg ystyried o dro i dro a fyddai arfer ei bwerau cydlafurio yn hyrwyddo amcan y cydlafurio wrth iddo arfer ei swyddogaethau eraill.

(2)Os daw corff addysg i'r casgliad y byddai arfer pŵer cydlafurio yn hyrwyddo amcan y cydlafurio wrth iddo arfer ei swyddogaethau, rhaid iddo geisio arfer y pŵer, neu beri iddo gael ei arfer.

(3)Mae'r ddyletswydd yn is-adran (1) yn gymwys i'r cyrff a grybwyllir ym mharagraffau (c) a (d) o adran 1 i'r graddau y mae'n ymwneud â darparu addysg uwchradd ac addysg bellach sy'n addas at anghenion personau nad ydynt eto'n 19 oed.

(4)Nid yw'r ddyletswydd yn is-adran (1) yn lleihau effaith y dyletswyddau yn—

(a)adran 33K o Ddeddf Dysgu a Medrau 2000 (cyflawni hawlogaethau cwricwlwm lleol ar gyfer myfyrwyr 16 i 18 oed: gweithio ar y cyd);

(b)adran 116J o Ddeddf Addysg 2002 (cyflawni hawlogaethau cwricwlwm lleol ar gyfer disgyblion yng Nghyfnod Allweddol 4: gweithio ar y cyd);

(c)adran 12 o Fesur Llywodraeth Leol (Cymru) 2009 (dyletswydd i bwyso a mesur a fyddai arfer un o'i bwerau cydlafurio yn ei helpu i gyflawni ei ddyletswyddau at ddibenion dyletswyddau o dan y Mesur hwnnw).
