The Department may, on giving at least 48 hours' notice to the person who appears to it to be the responsible person, carry out such repairs in a private street as are in its opinion urgently required to prevent or remove danger to persons or vehicles in the street.

Any expenses incurred under paragraph (1) shall be deemed to be expenses incurred by the Department under Article 13 and shall be recoverable accordingly.

The provisions of this Article shall be without prejudice to Articles 11 and 13.
