PENSIONS
The Pensions (2005 Order) (Commencement No. 6) Order (Northern Ireland) 2005
The Department for Social Development, in exercise of the powers conferred on it by Articles 1(2) and 287(3) of the Pensions (Northern Ireland) Order 2005() and of all other powers enabling it in that behalf, hereby makes the following Order:
Citation and interpretation
1.—(1) This Order may be cited as the Pensions (2005 Order) (Commencement No. 6) Order (Northern Ireland) 2005.
(2) In this Order, “the Order” means the Pensions (Northern Ireland) Order 2005 and any reference to a numbered Article or Schedule is a reference to the Article of, or Schedule to, the Order bearing that number.
Appointed days
2.—(1) The day appointed for the coming into operation of Article 85 (codes of practice), in so far as not already brought into operation, is 14th November 2005.
(2) The day appointed for the coming into operation of Article 220 (member-nominated trustees and directors: supplementary) is 1st November 2005.
(3) The day appointed for the coming into operation of—
(a)paragraphs 15 and 16 of Schedule 10 (amendment of sections 119 and 120 of the Pension Schemes Act) , and Article 290(1) in so far as it relates to those paragraphs, and
(b)Schedule 11 (repeals), in so far as it relates to the repeal of the definition of “occupational pension scheme” in subsection (2), and subsection (3), of section 119 of the Pension Schemes Act (interpretation), and Article 291 in so far as it so relates to those provisions,
is 22nd September 2005.
(4) The day appointed for the coming into operation of the provisions of the Order specified in Part 1 of the Schedule to this Order is 1st September 2005.
(5) The day appointed for the coming into operation of the provisions of the Order specified in Part 2 of the Schedule to this Order—
(a)for the purpose only of authorising the making of regulations, is 1st November 2005, and
(b)for all other purposes, is 6th April 2006.

Explanatory Note
This Order makes further provision for the coming into operation of the following provisions of the Pensions (Northern Ireland) Order 2005—
Articles 188 (remainder), 276, 279 (in part), 282, 283, 284, 286 and 290(2), paragraph 2(1) and (3) of Schedule 4, paragraph 70(3) of Schedule 10 (in part), and Schedule 11 (in part), on 1st September 2005;
paragraphs 15 and 16 of Schedule 10, and Schedule 11 (in part), on 22nd September 2005;
Article 220, on 1st November 2005;
Articles 218, 219 and 239, for the purpose only of authorising the making of regulations, on 1st November 2005, and for all other purposes, on 6th April 2006;
Article 85 (remainder), on 14th November 2005.
Note as to Earlier Commencement Orders
