The Department of Agriculture and Rural Development makes the following Order in exercise of the powers conferred by Article 1(3) of the Foyle and Carlingford Fisheries (Northern Ireland) Order 2007 (1).
1. This Order may be cited as the Foyle and Carlingford Fisheries (2007 Order) (Commencement No. 2) Order (Northern Ireland) 2012.
2. The day appointed for the coming into operation of the following provisions of the Foyle and Carlingford Fisheries (Northern Ireland) Order 2007 is 17th September 2012 –
(a)Article 34(1) (amendments) in so far as it relates to paragraph 2(5) of Schedule 2;
(b)paragraph 2(5) of Schedule 2 (amendment of section 26(1) of the Fisheries Act (Northern Ireland) 1966).

This Order brings into operation paragraph 2(5) of Schedule 2 of the Foyle and Carlingford Fisheries (Northern Ireland) Order 2007. Paragraph 2(5) of Schedule 2 amends section 26(1) of the Fisheries Act (Northern Ireland) 1966 to enable regulations to be made under that section with respect to the regulation or prohibition of the sale of any species of fish caught by rod and line.

An earlier Commencement Order, S.R. 2008 No 232 (C.10), provided for the coming into operation, on 1 June 2008, of the following provisions of The Foyle and Carlingford Fisheries (Northern Ireland) Order 2007—
(a)Article 3(1) for the purposes only of enabling regulations to be made in relation to aquaculture licensing, appeals and the register of aquaculture licences;
(b)Articles 4 to 31 which provide for miscellaneous amendments of the Foyle Fisheries Act (Northern Ireland) 1952;
(c)Articles 32 and 33 which make supplemental provision;
(d)Certain consequential amendments and repeals effected by Schedules 2 and 3, and Article 34 in so far as it relates to them.
