Coming into operation

The Department of Justice makes the following Regulations in exercise of the powers conferred by Article 12(6) of the Access to Justice (Northern Ireland) Order 20031 and now vested in it2.

In accordance with Article 46(5) of that Order, a draft of this Rule has been laid before and approved by a resolution of the Assembly.

Citation and commencement1

These Regulations may be cited as the Civil Legal Services (Scope) (No. 2) Regulations (Northern Ireland) 2016 and shall come into operation on 1st December 2016.

Amendment to Schedule 2 to the Access to Justice (Northern Ireland) Order 20032

In paragraph 2(d) of Schedule 2 to the Access to Justice (Northern Ireland) Order 2003, after paragraph (xxiv) insert—

under paragraph 2, 6 or 7 of Schedule 3 to the Human Trafficking and Exploitation (Criminal Justice and Support for Victims) Act (Northern Ireland) 20153;

under section 57, 60 or 61 of the Justice Act (Northern Ireland) 20154;

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Schedule 2 to the Access to Justice (Northern Ireland) Order 2003 regarding the proceedings which may be funded as civil legal services.

The effect of these amendments is to provide that representation in a court of summary jurisdiction relating to applications for Slavery and Trafficking Prevention Orders and applications for Violent Offences Prevention Orders may be funded as civil legal services.

The Regulations come into operation on 1st December 2016.
