The Student Fees (Inflation Index) Regulations (Northern Ireland) 2023

The Department for the Economy1, in exercise of the powers conferred by Article 4 (12) of the Higher Education (Northern Ireland) Order 2005 (“the 2005 Order”)2 makes the following Regulations.

Citation and commencement I11

These Regulations may be cited as The Student Fees (Inflation Index) Regulations (Northern Ireland) 2023 and come into operation on 13th October 2023.

Inflation Index I22

The index of prices to which the Department is required by Articles 4(11)(a)(i) and (b)(i) of the 2005 Order to have regard in satisfying itself that any increase to the basic and higher amounts is no greater than is required to maintain the value of the amount in real terms, is the All Items Retail Prices Index Excluding Mortgage Interest Repayments published by the Office for Budget Responsibility.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Article 4(12) of the 2005 Order enables the Department to specify an index of prices to which it must have regard in deciding whether any increase in the basic and higher tuition fee amounts is no greater than required to maintain the value of the amounts in real terms as specified under.

These Regulations set out that index.

The index is published by the Office for Budget Responsibility. The basic and higher tuition fee amounts are prescribed by the Student Fees (Amounts) Regulations (Northern Ireland) 2005 S.R.2005 No.290.

A Section 75 assessment is not required as there is no change to existing policy.
