3. In section 35(1) of the Coast Protection Act 1949 (operations excepted from the requirement to obtain consent under section 34)(1), after paragraph (h) insert–
“(ha)any operations authorised by an order under section 1 of the Transport and Works (Scotland) Act 2007;”.
1949 c. 74; paragraph (h) of section 35(1) was inserted by the Transport and Works Act 1992 (c. 42), section 19. There are other amendments to section 35 not relevant to these Regulations.
