Subject to paragraph (2), these Regulations apply to Scottish public authorities.

These Regulations shall not apply to any Scottish public authority to the extent that it is acting in a judicial or legislative capacity.

Nothing in these Regulations is to be taken to limit the powers of a Scottish public authority to disclose environmental information held by it.
