The Tenements (Scotland) Act 2004 (Consequential Provisions) Order 2004

Coming into force in accordance with article 1

The Scottish Ministers, in exercise of the powers conferred by section 31 of the Tenements (Scotland) Act 2004(1) and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 32(3) of that Act, been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  This Order may be cited as the Tenements (Scotland) Act 2004 (Consequential Provisions) Order 2004 and shall come into force on the day after the day on which it is made.

Amendment of Title Conditions (Scotland) Act 2003

2.—(1) The Title Conditions (Scotland) Act 2003(2) is amended in accordance with paragraph (2).

(2) In section 128(3)(a) for “2” substitute “1A”.

Explanatory Note

(This note is not part of the Order)

This Order amends section 128(3)(a) of the Title Conditions (Scotland) Act 2003 (asp 9) (“the 2003 Act”) in consequence of the provisions of the Tenements (Scotland) Act 2004 (?OQ?the 2004 Act). Section 25 and paragraph 20 of schedule 4 to the 2004 Act introduced schedule 1A into the 2003 Act. Section 128(3)(a) of the 2003 Act enables the schedules of the 2003 Act which set out forms to be amended by order of the Scottish Ministers. This order amends section 128(3)(a) to include the new form contained in schedule 1A.
