The Scottish Ministers make the following Order in exercise of the powers conferred by sections 44(1) and 60(3) of the Further and Higher Education (Scotland) Act 1992(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Designation of Institutions of Higher Education (The Scottish Agricultural College) (Scotland) (No. 2) Order 2008.
(2) Subject to paragraph (3), this Order comes into force on 31st May 2008.
(3) Article 2 comes into force on 1st June 2008.
2.—(1) The Scottish Agricultural College(2) is designated as an institution providing higher education for the purposes of Part II of the Further and Higher Education (Scotland) Act 1992.
(2) The designation of The Scottish Agricultural College by paragraph (1) shall remain in effect notwithstanding any change of name of that institution.
3. The Designation of Institutions of Higher Education (The Scottish Agricultural College) (Scotland) Order 2008(3) is revoked.

Article 2 of this Order designates The Scottish Agricultural College as an institution of higher education for the purpose of Part II of the Further and Higher Education (Scotland) Act 1992.
Designation of The Scottish Agricultural College as an institution of higher education has been granted by the Scottish Ministers following a designation audit by the UK Universities' Quality Assurance Agency for Higher Education based on a set of criteria in relation to quality set out by the Scottish Government. The audit found that The Scottish Agricultural College satisfied all the criteria.
Article 3 revokes the Designation of Institutions of Higher Education (The Scottish Agricultural College) (Scotland) Order 2008 (S.S.I. 2008/163).
1992 c. 37. Section 44(1) was amended by schedule 3, paragraph 6(1)(c) of the Further and Higher Education (Scotland) Act 2005 (asp 6). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
The Scottish Agricultural College is a charitable company limited by guarantee registered in Scotland with company number SC103046 and charity number SC003712 and having its registered office at West Mains Road, Edinburgh EH9 3JG.
