Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 71(1) of the Adoption and Children (Scotland) Act 20071 and all other powers enabling them to do so.

Citation and commencement1

This Order may be cited as the Period to Prepare an Adoption Allowances Scheme (Scotland) Order 2009 and comes into force on 28th September 2009.

Interpretation2

In this Order “the Act” means the Adoption and Children (Scotland) Act 2007.

Period to prepare an adoption allowances scheme3

An adoption agency which is a local authority must, within the period of 3 months after the coming into force of section 71 (Adoption allowances schemes) of the Act, prepare an adoption allowances scheme.

This Order directs that an adoption agency which is a local authority must, within 3 months from the coming into force of section 71 of the Adoption and Children (Scotland) Act 2007, prepare an adoption allowances scheme. Section 71 is scheduled to come fully into force on 28th September 2009 and therefore local authorities must prepare adoption allowances schemes by 28th December 2009.
