Coming into force in accordance with regulation 1
The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 98A(6) and 133(2D)(b) of the Education (Scotland) Act 1980(1) and all other powers enabling them to do so.
In accordance with section 133(2C)(a) of that Act(2), the Scottish Ministers have consulted such persons as they think fit on a draft of this instrument.
In accordance with section 133(2C)(b) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1. These Regulations may be cited as the Registration of Independent Schools (Prescribed Person) (Coronavirus) (Scotland) Amendment Regulations 2020 and come into force on the day after the day on which they are made.
2. In regulation 3 of the Registration of Independent Schools (Prescribed Person) (Scotland) Regulations 2017(3) (transitory provision), for “1st October 2020” substitute “1 June 2021”.

These Regulations amend regulation 3 of the Registration of Independent Schools (Prescribed Person) (Scotland) Regulations 2017 to provide that the requirement for a person employed as a teacher by an independent school on or before 1 October 2017 to register with the General Teaching Council for Scotland will take effect from 1 June 2021. The change made by these Regulations is necessary as a result of disruption caused by coronavirus (severe acute respiratory syndrome coronavirus 2 (SARSCoV-2)).
1980 c.44. Section 98A was inserted by section 24(2) of the Standards in Scotland’s Schools etc. Act 2000 (asp 6) and relevantly amended by section 4(2) of the School Education (Ministerial Powers and Independent Schools) (Scotland) Act 2004 (asp 12). Section 133(2D) was inserted by section 26 of the Education (Scotland) Act 2016 (asp 8).
Section 133(2C) was inserted by paragraph 1(7) of schedule 1 of the School Education (Ministerial Powers and Independent Schools) (Scotland) Act 2004 (asp 12).
