Schedule 1 (tenancies which cannot be private residential tenancies) of the Private Housing (Tenancies) (Scotland) Act 201631 is amended in accordance with this paragraph.

In paragraph 6 (holiday let), the existing words become sub-paragraph (1).

After that sub-paragraph insert—

A tenancy cannot be a private residential tenancy if it is a short-term let within the meaning of article 3 of the Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022.
