The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 10O of the National Health Service (Scotland) Act 1978(1) and all other powers enabling them to do so.
In accordance with section 105(3) of that Act(2), a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1. These Regulations may be cited as the Healthcare Improvement Scotland (Inspections) Amendment Regulations 2024 and come into force on 19 June 2024.
2.—(1) The Healthcare Improvement Scotland (Inspections) Regulations 2011(3) are amended in accordance with paragraph (2).
(2) In regulation 5(4) (power to require information) after “health professional” insert “or a person authorised by HIS to carry out an inspection under section 10K (authorised persons)”.

These Regulations amend the Healthcare Improvement Scotland (Inspections) Regulations 2011 (“the 2011 Regulations”).
Regulation 2 amends regulation 5(4) (power to require information) of the 2011 Regulations to provide that a person authorised to carry out an inspection under section 10K of the National Health Care (Scotland) Act 1978 can inspect medical records.
1978 c. 29. Section 10O was inserted by section 108 of the Public Services Reform (Scotland) Act 2010 (asp 8).
Section 105(3) was relevantly amended by paragraph 21(a) of schedule 17 of the Public Services Reform (Scotland) Act 2010.
S.S.I. 2011/184, to which there are amendments not relevant to these Regulations.
