(2)[F2Subject to section 74(3) of this Act and to section 20 of the Water (Scotland) Act 1980] Nothing in sections 70 to 78 of this Act shall affect any provision relating to the acquisition by agreement or compulsorily, appropriation, letting or disposal of land, the erection of buildings or the execution of works by a local authority contained in any of the following enactments or any instrument made thereunder—
(a)The Burial Grounds Acts;
(b)The Military Lands Acts 1892 to 1903;
(c)The M1Cremation Act 1902;
(d)The Housing (Scotland) [F3Act 1987];
[F4(e)The Water (Scotland) Act 1980;]
(f)The Education (Scotland) Acts 1939 to 1973;
(g)The M2Police (Scotland) Act 1967;
(h)Any local Act.
(3)Any enabling provision contained in this Act shall be in addition to, and not in derogation of, any powers exercisable by Her Majesty by virtue of her royal prerogative.
