Section 12 (power to impose restrictions in relation to aircraft) is amended as follows.

In subsection (9) for refuses or there is substituted “ , without reasonable excuse, ”.

After subsection (9) there is inserted—(10)

Where a person is convicted of an offence under subsection (9) above, then, if without reasonable excuse the failure in respect of which he was convicted is continued after the conviction, he shall be guilty of a further offence and liable on summary conviction to a fine not exceeding one-tenth of level 5 on the standard scale for each day on which the failure continues.
