6E+WNothing in any provision of this Act or of any order made under this Act shall be construed as exempting the [appropriate agency] from any liability to which it would, apart from that provision, have been subject in respect of any damage to any mines or minerals underlying any part of its undertaking or in respect of any loss sustained in relation to any such mines or minerals by a person having an interest therein.
