This paragraph applies if the qualifying lease is not varied in accordance with paragraph 7(2).

(2)

The appropriate tribunal may, on an application made by the tenant or the landlord, make—

(a)

such order as it thinks fit with respect to the making of that variation of the qualifying lease, or

(b)

an order declaring that the rent variation notice is to cease to have effect.

(3)

An order under this paragraph may appoint a person to execute the variation of the lease on behalf of a party to the variation; and a variation executed in consequence of such an order has the same force and effect (for all purposes) as if it had been executed by that party.

(4)

Any application for an order under sub-paragraph (2) must be made within the period of four months beginning with the day on which the rent variation notice becomes enforceable (within the meaning of paragraph 7).
