The Reciprocal Enforcement of Judgments (Pakistan) Order, 1958

At the Court at Buckingham Palace, the 28th day of January, 1958

Present,

The Queen's Most Excellent Majesty in Council.

Her Majesty, by virtue and in exercise of the powers conferred on Her by section one of the Foreign Judgments (Reciprocal Enforcement) Act, 1933, and of all other powers Her enabling, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order may be cited as the Reciprocal Enforcement of Judgments (Pakistan) Order, 1958.

The Reciprocal Enforcement of Judgments (Pakistan) Order, 19531, is hereby revoked provided that in relation to judgments given before the date of this Order the High Courts of Dacca and Lahore, the Chief Court at Karachi and the Judicial Commissioners' Courts at Peshawar and Quetta shall continue to be deemed to be Superior Courts for the purposes of Part I of the Act.

Part I of the Act shall extend to all the territories of Pakistan.

The following Courts of Pakistan shall be deemed Superior Courts for the purposes of Part I of the Act, that is to say:—

a

The Supreme Court of Pakistan and all High Courts.

b

All District Courts.

c

All other Courts whose civil jurisdiction is subject to no pecuniary limit provided that the Judgment sought to be registered under the Act is sealed with a seal showing that the jurisdiction of the Court is subject to no pecuniary limit.

EXPLANATORY NOTE

The purpose of this Order is to revise the list of Courts of Pakistan deemed to be Superior Courts for the purpose of Part I of the Act, and to continue the application of Part I of the Act in respect of judgments of Courts of Pakistan which have ceased to exist.
