The Charities (National Trust for Places of Historic Interest Or Natural Beauty) Order 1975

Whereas the Charity Commissioners for England and Wales have, in pursuance of section 19(1) of the Charities Act 1960, settled the Scheme set out in the Appendix to this Order with a view to its being given effect under that section:
And Whereas the said Scheme does not alter any statutory provision contained in or having effect under any public general Act of Parliament:
Now, therefore, I, the Right Honourable Roy Harris Jenkins, one of Her Majesty's Principal Secretaries of State, in pursuance of section 19(2) of the Charities Act 1960, hereby make the following Order:—
1. This Order may be cited as the Charities (National Trust for Places of Historic Interest or Natural Beauty) Order 1975 and shall come into operation on the fourteenth day after the day on which it is made.
2. The Scheme set out in the Appendix to this Order shall have effect.

APPENDIXSCHEME FOR THE ADMINISTRATION OF THE CHARITY CALLED NATIONAL TRUST FOR PLACES OF HISTORIC INTEREST OR NATURAL BEAUTY
Whereas the Charity called the National Trust for Places of Historic Interest or Natural Beauty is now regulated by:
(1)
the National Trust Act 1907();
(2)
the National Trust Charity Scheme Confirmation Act 1919;
(3)
the National Trust Act 1937;
(4)
the National Trust Act 1939;
(5)
the National Trust Act 1953;
(6)
the National Trust Act 1971:
And Whereas the Charity has made application to the Charity Commissioners for a Scheme for the administration thereof;
And Whereas it appears to the Charity Commissioners that a Scheme should be established for the administration of the Charity but that it is necessary for the Scheme to alter the provision made by the said Act of 1971:
And Whereas in pursuance of section 21 of the Charities Act 1960 public notice of the Charity Commissioners' proposals for this Scheme has been given and no representations have been received by the Charity Commissioners in respect thereof:
And Whereas all the charity trustees were party or privy to the application aforesaid:
Now, therefore, the Charity Commissioners for England and Wales, in pursuance of section 19(1) of the Charities Act 1960, hereby settle the following Scheme:—
SCHEME
1. Executive Committee.—Notwithstanding the provisions of section 12(1) of the above-mentioned Act of Parliament of the year 1971 for the constitution of the executive committee of the above-mentioned Charity the executive committee shall consist of the chairman of each of the regional committees and other persons appointed by the council of the Charity but so that a majority of the executive committee shall be persons who are members of the council.
2. Questions of construction.—Any question as to the construction of this Scheme may be referred to the Charity Commissioners for their opinion or advice in accordance with the provisions of section 24 of the Charities Act 1960.
This Order gives effect to a Scheme of the Charity Commissioners relating to the National Trust for Places of Historic Interest or Natural Beauty, which is regulated by the National Trust Acts 1907 to 1971.
This Scheme removes the limit upon the number of members of the executive committee and makes consequential provision as to the proportion of members of that committee who must be members of the Council of the National Trust.
