Coming into Operation
The Secretary of State, in exercise of the powers conferred by section 10 of the Wireless Telegraphy Act 1949 as enacted, and as extended by the Wireless Telegraphy (Channel Islands) Order 1952 and the Wireless Telegraphy (Isle of Man) Order 1952 and now vested in him1 and after consultation with the advisory committee appointed under section 9 of the said Act, hereby makes the following Regulations:—

These Regulations may be cited as the Wireless Telegraphy (Control of Interference from Citizens' Band Radio Apparatus) Regulations 1982 and shall come into operation on 10th June 1982.

In these Regulations—
“CB apparatus” means Citizens' Band Radio apparatus, that is to say, wireless telegraphy apparatus designed or adapted for the purpose of transmitting or receiving spoken messages on the frequency channels specified in paragraph 1.3 of the relevant specification;
“relevant specification” means—
- a
in relation to CB apparatus designed or adapted to operate in the frequency band 27.60125 MHz to 27.99125 MHz, Home Office Performance Specification MPT 1320 published in April 1981;
- b
in relation to CB apparatus designed or adapted to operate in the frequency band 934.025 MHz to 934.975 MHz, Home Office Performance Specification MPT 1321 published in April 1981.

The requirements specified in the Schedule to these Regulations shall be complied with in the case of any CB apparatus which is sold otherwise than for export, or offered or advertised for sale otherwise than for export, or let on hire or offered or advertised for letting on hire, by any person who in the course of business manufactures, assembles or imports CB apparatus.

Any CB apparatus which, by virtue of Regulation 3, is required to comply with the requirements specified in the Schedule to these Regulations, shall, in order to show that it does so comply, be marked in accordance with paragraph 1.6 of the relevant specification.
SCHEDULEREQUIREMENTS TO BE COMPLIED WITH IN THE CASE OF CB APPARATUS REFERRED TO IN REGULATION 3

In this Schedule—
“adjacent channel power”, “carrier power”, “frequency deviation” and “frequency error” have the meanings respectively assigned to them by paragraphs 4.4.1., 4.2.1., 4.3.1. and 4.1.1. of the relevant specification;
“BS 4727: Part 3: Group 01: 1971” means the British Standard Glossary of Electrotechnical, Power, Telecommunication, Electronics, Lighting and Colour Terms Part 3 Group 01 (General telecommunication and electronics terminology) published in August 1971;
“carrier frequency”, “frequency modulation”, “modulation” and “phase modulation” have the meanings assigned to them by BS 4727: Part 3: Group 01: 1971;
“spurious emissions” has the meaning assigned to it by paragraph 4.5.1. or (as the case may be) 5.1.1. of the relevant specification.

Where reference is made in this Schedule to the measurement of any of the characteristics of CB apparatus, the reference is to measurement carried out under the conditions specified in Chapters 2 and 3 of the relevant specification, accurate within the tolerance specified in Chapter 6 of the relevant specification and following tests carried out in accordance with Chapter 7 of the relevant specification

The modulation of the CB apparatus shall be frequency modulation or phase modulation.

The frequency error of the CB apparatus shall be that specified in paragraph 4.1.3. of the relevant specification when measured by the method described in paragraph 4.1.2. of the relevant specification.

The carrier power of the CB apparatus shall not exceed that specified in paragraph 4.2.4. of the relevant specification when measured by the method described in paragraphs 4.2.2. and 4.2.3. of the relevant specification.

The frequency deviation of the CB apparatus shall not exceed that specified in paragraph 4.3.3. of the relevant specification when measured by the method described in paragraph 4.3.2.2. of the relevant specification.

The adjacent channel power of the CB apparatus shall not exceed that specified in paragraph 4.4.3. of the relevant specification when measured by the method described in paragraph 4.4.2. of the relevant specification using the equipment described in paragraph 4.4.4. of the relevant specification.

In the case of CB apparatus designed or adapted for emission the power of spurious emissions shall not exceed that specified in paragraph 4.5.4. of the relevant specification when measured by the methods described in paragraphs 4.5.2. and 4.5.3. of the relevant specification.

In the case of CB apparatus designed or adapted for reception the power of spurious emissions shall not exceed that specified in paragraph 5.1.4. of the relevant specification when measured by the method described in paragraph 5.1.2. or 5.1.3. (as the case may be) of the relevant specification.

In the case of CB apparatus which is designed or adapted for the purpose of transmitting or receiving spoken messages on more than one of the frequency channels specified in paragraph 1.3. of the relevant specification, there shall be the separation specified in paragraph 1.1. of the relevant specification between adjacent channel carrier frequencies.

The CB apparatus shall not be capable of transmitting or receiving digital signals except digital signals designed solely for the purpose of identifying or selecting a particular station or for indicating the end of a transmission.
