Coming into Operation

The Secretary of State for Transport, in exercise of the powers conferred by sections 47(1) and 50(1) of the Road Traffic Act 19721, and now vested in him2, and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of the said Act, hereby makes the following Regulations:—

These Regulations may be cited as the Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1985, and shall come into operation on 2nd December 1985.

The Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 are hereby amended so that in Regulation 3 (Application), in paragraph (2), at the end of sub-paragraph (i) “or” is omitted, for the full-stop at the end of sub-paragraph (j) there is substituted “;” and there are added the following sub-paragraphs:—

k

a motor vehicle for which a first licence was granted under the Vehicles (Excise) Act (Northern Ireland) 19723 on or after 2nd December 1985; or

l

a motor vehicle in respect of which there exists a certificate issued in accordance with the provisions of Article 31A of the Road Traffic (Northern Ireland) Order 19814

EXPLANATORY NOTE

These Regulations further amend the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 by exempting from the application of those Regulations a motor vehicle which is first registered under the Vehicles (Excise) Act (Northern Ireland) 1972 on or after 2nd December 1985 or a motor vehicle in respect of which there exists a certificate issued in accordance with the provisions of Article 31A of the Road Traffic (Northern Ireland) Order 1981.
