Coming into Operation
The Secretary of State, in exercise of the powers conferred by section 10 of the Wireless Telegraphy Act 1949 as enacted, and also as extended by the Wireless Telegraphy (Channel Islands) Order 1952 and the Wireless Telegraphy (Isle of Man) Order 1952 and now vested in him1, and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

These Regulations may be cited as the Wireless Telegraphy (Control of Interference from Fluorescent Lighting Apparatus) (Amendment) Regulations 1985 and shall come into operation on 29th July 1985.

In these Regulations, “the principal Regulations” mean the Wireless Telegraphy (Control of Interference from Fluorescent Lighting Apparatus) Regulations 1978.

Regulation 2 of the principal Regulations shall have effect subject to the following amendments, that is to say—
a
for the definition of “BS5394: Part 1 1976”
there shall be substituted the following definition:—
‘“BS5394: 1983” means the British Standard Specification for radio interference limits and measurements for luminaires using tubular fluorescent lamps and fitted with starters. BS5394: 1983 published on 31 May 1983;’
b
for the definition of “the Directive”
there shall be substituted the following definition:—
‘“the Directive” means Council Directive No.76/890/EEC2 as amended by Commission Directive No.82/500/EEC3;’

For Regulation 6 of the principal Regulations there shall be substituted the following Regulation:—

The insertion loss of the luminaire within the meaning of Clause 3.5 of BS5394: 1983 as measured by the method prescribed in Clause 5 thereof shall not be less than the minimum values relevant to that luminaire prescribed in Clause 4 thereof (being values which are related to the frequencies at which the fluorescent lighting apparatus generates electro-magnetic energy).

In relation to the testing of a luminaire and the minimum values of insertion loss thereof the relevant procedures, requirements and specifications set out in BS5394: 1983 shall be complied with.
