The Wireless Telegraphy (Control of Interference From Household Appliances, Portable Tools Etc.) (Amendment) Regulations 1985

1.  These Regulations may be cited as the Wireless Telegraphy (Control of Interference from Household Appliances, Portable Tools etc.) (Amendment) Regulations 1985 and shall come into operation on 29th July 1985.

2.  In these Regulations “the principal Regulations” mean the Wireless Telegraphy (Control of Interference from Household Appliances, Portable Tools etc.) Regulations 1978.

3.  Regulation 2 of the principal Regulations shall have effect subject to the following amendments, that is to say—

(a)for the definition of “B.S.800: 1977” there shall be substituted the following definition:—

  

‘“B.S.800: 1983” means the British Standard Specification for radio interference limits and measurements for household appliances, portable tools and other electrical equipment causing similar types of interference, B.S.800: 1983 published on 31st May 1983;’ means the British Standard Specification for radio interference limits and measurements for household appliances, portable tools and other electrical equipment causing similar types of interference, B.S.800: 1983 published on 31st May 1983;’

(b)for the definition of “the Directive” there shall be substituted the following definition:—

‘“the Directive” means Council Directive No. 76/889/EEC(2) as amended by Commission Directive No. 82/499/EEC(3); means Council Directive No. 76/889/EECO.J. No. L.336, 4.12.76, p.1. as amended by Commission Directive No. 82/499/EECO.J. No. L.222, 30.7.82, p.1.’;

(c)in the definition of “lighting dimmer”, the words “and which has a power rating not exceeding 1000 watts” shall be omitted.

4.  In Regulation 3 of the principal Regulations the words “(details of which are contained in clause 1.1 of B.S.800: 1983)” shall be substituted for the words “(examples of which are contained in Appendices A and B to B.S.800: 1977)”.

5.  For Regulation 6 of the principal Regulations there shall be substituted the following Regulation:—

   

6.  The apparatus shall be measured in the manner prescribed by Clauses 6 and 7 of B.S.800: 1983 and shall comply with the relevant limits of interference prescribed in Clause 4 thereof and, in relation to the testing of the apparatus, and the limits of interference thereof, any other relevant procedures, requirements and specifications set out in B.S.800: 1983 shall be complied with..

EXPLANATORY NOTE

These Regulations amend the Wireless Telegraphy (Control of Interference from Household Appliances, Portable Tools etc.) Regulations 1978 which relate to the control of radio interference caused by household appliances, portable tools and other equipment. Council Directive No. 76/889/EEC, which formed the basis for the earlier Regulations including the details of the apparatus to which it applies, was adapted to technical progress by Commission Directive No. 82/499/EEC. It is from the Annex to this latter Directive that the requirements contained in British Standard Specification B.S.800: 1983, which has replaced B.S.800: 1977 in these Regulations, are derived.

Section 89 of the Telecommunications Act 1984 (c.12) has abolished the advisory committee on interference with wireless telegraphy established under Section 9(1)(a) of the Wireless Telegraphy Act 1949, and accordingly, the provisions of Section 10 of that Act, making consultation of the committee necessary before regulations can be made under the section, cease to have effect.
