The Secretary of State for Wales in exercise of the powers conferred on him by section 176(1) and (5) of the Housing Act 1985(1) as extended by subsections (2) and (3) of the section 2 of the Welsh Language Act 1967(2) and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) Regulations 1988 and shall come into force on 1st September 1988.

(2) In these Regulations “the principal Regulations” means the Housing (Right to Buy) (Prescribed Forms) Regulations 1986(3).

2.  The forms set out in Schedules 1 and 2 to these Regulations are hereby prescribed as versions in Welsh which may be used instead of the forms in Schedules 1 and 2 to the principal Regulations for the purposes of sections 122(1) and 124(1) of the Housing Act 1985.

3.  Forms substantially to the like effect to the forms set out in Schedules 1 and 2 to these Regulations may be used.

4.  The particulars to be contained in any notice, the form of which is prescribed by regulations 2 and 3 above, shall be those required by that form.

5.—(1) The Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) (No. 3) Regulations 1985(4) are hereby revoked.

(2) Nothing in these Regulations shall affect the validity of any notice served by a secure tenant under section 122(1) of the Housing Act 1985(5) before 1st November 1988 1988 if the notice was in the form prescribed by the regulations mentioned in paragraph (1) above or in a form substantially to the like effect.

Hysbysiad yw hwn a ddefnyddir gan denantiaid cynghorau a rhai tenantiaid arbennig eraill (e.e. tenantiaid trefi newydd a thenantiaid cymdeithasau tai) sydd am arfer eu hawl i brynu eu cartrefi.

Cyn llenwi unrhyw ran o'r hysbysiad hwn darllenwch y y nodiadau sy'n ymwneud â'r rhan honno.

Gall fod o gymorth i chi ddarllen llyfryn y Llywodraeth “Eich Hawl i Brynu'ch Cartref”. Gallwch gael copi oddi wrth eich landlord, mewn Canolfan Cynghori neu drwy ysgrifennu at yr Adran Hysbysrwydd, Y Swyddfa Gymreig, Parc Cathays, Caerdydd CF1 3NQ.

Os hoffech gael cyngor, gallwch gael cymorth yn y Ganolfan Cynghori neu ymgynghori â chyfreithiwr. Fe all y byddwch yn gymwys i gael cymorth i dalu cyfreithiwr am ei gyngor o dan y Cynllun Cymorth Cyfreithiol.

Ar ôl i chi lenwi'r hysbysiad hwn, ewch ag ef, neu ei anfon drwy'r post a defnyddio'r gwasanaeth dosbarthiad a gofnodwyd, ateich landlord. Os ewch ag ef eich hun gofynnwch am dderbynneb. Cadwch gopi o'r hysbysiad ar ôl i chi ei lenwi.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe Welsh versions of the forms of notice for use in connection with the right to buy under sections 122(1) and 124(1) of the Housing Act 1985 (regulations 2 and 3) and the particulars to be contained in them (regulation 4). The forms are—

(a)the form of notice to be used by a secure tenant to claim the right to buy (Form RTB 1); and

(b)the form of notice to be used by a landlord to accept or reject the tenant’s claim (Form RTB 2).

The forms replace those prescribed by the Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) (No. 3) Regulations 1985 which are revoked (regulation 5(1)1. A notice claiming the right to buy served by a secure tenant before 1st November 1988 is not invalidated by these Regulations if it is in the form required by the 1985 Regulations or in a substantially similar form (regulation 5(2)).

Mae'r rheolau hyn yn pennu fersiynau Cymraeg o'r ffurflenni hysbysu sydd i'w defnyddio mewn cysylltiad â'r hawl i brynu o dan adrannau 122(1) ac 124(1) Deddf Tai 1985 (rheolau 2 a 3) a'r manylion sydd i'w cynnwys ynddynt (rheol 4). Y ffurflenni hyn yw:

(a)y ffurflen hysbysu sydd i'w defnyddio gan denant diogel i wneud cais am yr hawl i brynu (Ffurflen RTB1);

(b)y ffurflen hysbysu sydd i'w defnyddio gan landlord i dderbyn neu wrthod cais y tenant (Ffurflen RTB2).

Mae'r ffurflenni hyn yn disodli'r rhai a bennwyd gan “The Housing (Right to Buy) (Prescribed Forms) (Welsh Forms) (No. 3) 1985”, sy'n cael eu diddymu (rheol 5(1)). Ni ddirymir hysbysiad sy'n ceisio'r hawl i brynu a gyflwynwyd gan denant diogel cyn 1af Tachwedd 1988 gan y rheolau hyn os yw'n dilyn trefn y ffurflen a fynnir gan Reolau 1985 neu ar ffurf sy'n sylweddol debyg iddi (rheol 5(2)).

By virtue of section 2(2) of the Housing (Consequential Provisions) Act 1985 (c. 71), a notice served under section 5(1) of the Housing Act 1980 (c. 51) has effect as if served under section 122(1) of the Housing Act 1985.
