The Secretary of State for Transport, in exercise of the powers conferred by section 14 of the Harbours Act, 1964(1) and now vested in him(2) and of all other powers enabling him in that behalf and on the application of the Fenland District Council in accordance with section 7(5) of the Pilotage Act, 1987(3), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Port of Wisbech (Pilotage) Harbour Revision Order 1988, and shall come into force on 1st October 1988.

Interpretation

2.  In this Order—

“the harbour” means the limits of the Port of Wisbech as defined in the Wisbech Town Act, 1810;

“the Harbour Authority” means the Fenland District Council;

“the signed plan” means the plan marked “Plan referred to in the Port of Wisbech (Pilotage) Harbour Revision Order 1988” signed in triplicate by an Under Secretary in the Department of Transport, two copies of which have been deposited at that Department and one copy of which has been deposited at the offices of the Harbour Authority situated at Fenland Hall, County Road, March, Cambridgeshire,PE15 8NQ.

Extension of limits of jurisdiction for purposes of pilotage

3.  The limits within which the Harbour Authority shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the harbour) so much of the waters of the Wash outside the harbour as lie within the following imaginary straight lines, marked as black lines on the signed plan—

(a)a line drawn due north (true) from a point on the coast of Norfolk at latitude 52° 48'.32N, longitude 0° 20'.E to a point at latitude 52° 55'.24N, longitude0° 20'.E;

(b)a line drawn thence west to a point at latitude 52° 55'.24N, longitude 0° 09'.23E; and

(c)a line drawn thence in a southerly direction to a point on the coast of Lincolnshire at latitude 52° 52'.06N, longitude 0° 09'.30E.

together with all navigable rivers, canals and cuts downstream of Wisbech Bridge running into the waters of the Wash within the above mentioned limits, and including all tidal and closed docks within such limits but excluding any waters within the limits of compulsory pilotage of the King’s Lynn Conservancy Board and the Port of Boston Authority.

Explanatory Note

(This note is not part of the Order)

By virtue of section 7(5) of the Pilotage Act 1987, a direction given by a competent harbour authority for the purpose of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the authority’s harbour unless the limits of jurisdiction of the authority for pilotage purposes have been extended to cover that area.

This Order accordingly extends the limits of jurisdiction of the Fenland District Council for pilotage purposes under Part I of the Pilotage Act 1987, so as to include an area outside the Port in respect of which the authority considers that pilotage should be compulsory.

The applicant for this Order is the Fenland District Council, being the competent harbour authority for the Port of Wisbech.
