The Secretary of State for Transport, in exercise of the powers conferred by section 9 of the Metropolitan Public Carriage Act 18691, section 1 of the London Cab and Stage Carriage Act 19072 and section 1 of the London Cab Act 19683, hereby makes the following Order:

Citation, commencement and introduction

This Order may be cited as the London Cab Order 1988 and shall come into force on 25th June 1988.

The London Cab Order 19344 shall be amended in accordance with the following provisions of this Order.

Scales of fares3

For paragraph 40 (scales of fares excluding extras) there shall be substituted the following—

Subject to the following provisions of this paragraph, the fare payable for the hiring of a motor cab shall be according to the following scale—

a

a hiring charge of 40p, and

b

in respect of any part of the hiring during which the cab travels at a speed exceeding 10.2 miles an hour, at the rate of 20p for 435 yards or, if the fare shown on the taximeter is £5.60 or more, thereafter at the rate of 20p for 290 yards, and

c

in respect of any part of the hiring during which the cab is stationary or travels at a speed not exceeding 10.2 miles an hour, at a rate of 20p for 87 seconds or, if the rate shown on the taximeter is £5.60 or more, thereafter at the rate of 20p for 58 seconds.

In any case where the fare according to the scale prescribed in sub-paragraph (1) above is less than £1.00 the fare payable shall be £1.00, and in any other case where the fare exceeds a multiple of 20p by a sum which is less than 20p the fare payable shall be the next higher multiple of 20p.

At any time during the transitional period specified in Schedule E to this Order when a motor cab is fitted with a taximeter which is not capable of recording and displaying automatically the fare payable according to the scale prescribed in sub-paragraph (1) above, the fare payable—

a

where the fare shown on the meter does not exceed £10.00 shall, if a notice in the terms set out in that Schedule is kept prominently displayed in the cab in such a manner as to be clearly legible to the hirer, be, as respects a fare shown on the meter, the figure in the column headed “Fare payable” opposite to the figure in the column headed “Shown on meter”, and otherwise shall be the fare shown on the meter;

b

where the fare shown on the meter exceeds £10.00 shall, as respects the amount by which the fare shown exceeds the highest multiple of £10.00 in that fare, be the fare payable under the foregoing provisions of this sub-paragraph and in addition £10.70 shall be payable as respects each multiple of £10.00 in the fare shown on the meter.

For Schedule E there shall be substituted the Schedule set out in the Schedule to this Order.

SCHEDULE EINCREASE OF FARES

Paragraph 40(3)

From 25th June 1988 to 30th September 1988 (inclusive) (in this Order referred to as “the transitional period” for all journeys beginning and ending within the Metropolitan and/or City Police Districts the fare shown on the taximeter, excluding extras, is (as authorised by the London Cab Order 1988) increased as shown in the following Table—

This Order increases the fares payable for the hiring of a motor cab in the Metropolitan Police District and the City of London in respect of all journeys beginning and ending there. This is achieved by substituting a new paragraph 40 (scale of fares for motor cabs) — see article 3. The Schedule to the Order provides a conversion table setting out the new fares for cabs with taximeters which are not capable of recording those fares automatically. The table is required to be kept prominently displayed in the cab and may only be used during the transitional period from 25th June 1988 to 30th September 1988 after which all taximeters must be capable of automatically recording and displaying the increased fare.
