CHANGES IN LOCAL GOVERNMENT AREAS

The Essex (District Boundaries) Order 1989

for the purposes referred to in article 1(2)

for all other purposes

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(5) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Essex (District Boundaries) Order 1989.

(2) This Order shall come into force on 26th September 1989 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes this Order shall come into force on 1st October 1989.

Interpretation

2.  In this Order –

“boundary map” means the map prepared by the Department of the Environment, marked “Map of the Essex (District Boundaries) Order 1989”, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“county electoral division” means an electoral division of the county of Essex.

Transfers from Epping Forest to Harlow

3.—(1) The part of the district of Epping Forest and the parish of Matching marked B1 on the boundary map shall be transferred to –

(a)the district of Harlow;

(b)the Old Harlow ward of that district;

(c)the Harlow and Mark Hall county electoral division,

and shall cease to form part of any parish.

(2) The part of the district of Epping Forest and the parish of North Weald Bassett marked B2 on the boundary map shall be transferred to –

(a)the district of Harlow;

(b)the Potter Street ward of that district;

(c)the Harlow Common county electoral division;

(d)the Harlow petty sessional division,

and shall cease to form part of any parish.

Town and county planning

4.  Any provisions of a local plan made by Epping Forest District Council which apply immediately before 1st October 1989 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan made by Harlow District Council.

Explanatory Note

(This note is not part of the Order)

This Order transfers an area in the county of Essex from the district of Epping Forest to the district of Harlow. Consequential changes to parishes and local government electoral areas are made.

The map forming part of this note (page 3) gives a general guide to the areas affected. Prints of the detailed boundary map (described in article 2) may be inspected at all reasonable times at the offices of the Epping Forest and Harlow district councils and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P 3EB.

The area transferred has approximately an area of 496 hectares, a population of 85 and a rateable value of £8,843.

The Local Government Area Changes Regulations 1976 (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
