CHANGES IN LOCAL GOVERNMENT AREAS

The Buckinghamshire (District Boundaries) Order 1990

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 49(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Buckinghamshire (District Boundaries) Order 1990.

(2) This Order shall come into force on 9th March 1990 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes this Order shall come into force on 1st April 1990.

Interpretation

2.  In this Order–

“boundary map” means the map prepared by the Department of the Environment, marked “Map of the Buckinghamshire (District Boundaries) Order 1990” and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“county electoral division” means an electoral division of the county of Buckinghamshire.

Transfers from Chiltern to South Bucks

3.—(1) The parts of the district of Chiltern and the parish of Penn marked A2, A3, A4 and A5 on the boundary map shall be transferred to–

(a)the district of South Bucks and the Beaconsfield North ward of that district;

(b)the parish of Beaconsfield and the North ward of that parish;

(c)the Beaconsfield county electoral division;

(d)the Burnham petty sessional division.

(2) The part of the district of Chiltern and the parish of Penn marked A1 on the boundary map shall be transferred to–

(a)the district of South Bucks and the Beaconsfield West ward of that district;

(b)the parish of Beaconsfield and the West ward of that parish;

(c)the Beaconsfield county electoral division;

(d)the Burnham petty sessional division.

Transfer from South Bucks to Chiltern

4.  The parts of the district of South Bucks and the parish of Beaconsfield marked A6, A7 and A8 on the boundary map shall be transferred to–

(a)the district of Chiltern and the Penn ward of that district;

(b)the parish of Penn and the Penn ward of that parish;

(c)the Amersham Town and Penn county electoral division;

(d)the Chiltern petty sessional division.

Town and country planning

5.  Any provisions of a local plan made or adopted by a district council which apply immediately before 1st April 1990 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan made or adopted by the council of the district to which that area is transferred.

Explanatory Note

(This note is not part of the Order)

This Order transfers areas in the county of Buckinghamshire between the district of Chiltern and the district of South Bucks. Consequential changes to parishes and local government electoral areas are made.

The map forming part of this note gives a general guide to the areas affected. Prints of the detailed boundary map (described in article 2) may be inspected at all reasonable times at the offices of the Chiltern and South Bucks district councils and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P 3EB.

The areas transferred to South Bucks comprise approximately 19.24 hectares in total and have a population of approximately 124. The area transferred to Chiltern comprises approximately 1.5 hectares and has a population of approximately 30.

The Local Government Area Changes Regulations 1976 (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
