The Secretary of State for Transport, in exercise of the powers conferred by sections 97(1)(a), 105(1), (2)(e) and (4) and 108(1)(1) of the Road Traffic Act 1988(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, and with the approval of the Treasury, hereby makes the following Regulations:

1.  These Regulations may be cited as the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) (Amendment) (No. 4) Regulations 1991 and shall come into force on 1st February 1992.

2.  The Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990(3) shall be amended by substituting for Schedule 3 thereof Schedule 1 to these Regulations.

SCHEDULE 3FEES FOR LICENCES

Description of LicenceFee
(1) A full licence for any category not being a licence falling in paragraph (2) or (3) below or a licence granted in exchange for a provisional licence (including a licence which is so treated under section 98 of the 1988 Act).£21
(2) The fning a full licence except where his previous such licence was revoked and, but for its revocation, would have expired before or within 3 months after the date of his current application for a licence. a full licence except where his previous such licence was revoked and, but for its revocation, would have expired before or within 3 months after the date of his current application for a licence.£12
(3) The first full licence for any category granted to a person after he has passed a driving he date of his current application for a licence. of the 1988 Act except where his previous full licence was revoked and, but for its revocation, would have expired before or within 3 months after the date of his current application for a licence.£6
(4) A provisional licence not being a licence falling in paragraph (5) below. £21
(5) The first provisional licence granted to a person after he has been ordered to take a driving test under section 117 of the 1988 Act. £12
(6) A full lgv trainee driver’s licence for category C or an lgv trainee driver’s provisional licence for category C plus E granted to the holder of an hgv trainee driver’s full licence to drive heavy goods vehicles of class 2 or 3. £6

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990 by substituting a new Schedule 3 for the existing one. The principal changes introduced by the new Schedule 3 are as follows:

  • the fee for a full large goods vehicle (lgv) driver’s licence, except one granted in exchange for a provisional licence or following a period of disqualification, is increased from £10 to £21;

  • the fee for a full passenger-carrying vehicle (pcv) driver’s licence, except one granted in exchange for a provisional licence or following a period of disqualification, is reduced from £22.50 to £21;

  • the fee for a provisional lgv or pcv driver’s licence is increased from £5 to £21, except where the licence is granted to a person after he has been ordered to take a driving test under section 117 of the Road Traffic Act 1988 “the 1988 Act”, in which case the fee is increased from £5 to £12;

  • the fee for a full lgv or pcv driver’s licence granted following the expiration of a period of disqualification for holding or obtaining such a licence is increased from £5 to £12, except where the licence is granted to a person after he has passed a driving test which he was ordered to take under section 117 of the 1988 Act, in which case the fee is increased from £5 to £6; and

  • the fee for a full lgv trainee driver’s licence for category C and for an lgv trainee driver’s provisional licence for category C plus E granted to the holder of a heavy goods vehicle (hgv) trainee driver’s full licence to drive hgvs of class 2 or 3 is increased from £5 to £6.

It should be noted that no fee is charged when a person exchanges a provisional for a full lgv or pcv driver’s licence except where the person has just passed a test which he was ordered to take under section 117 of the 1988 Act.
