The Merchant Shipping (Load Lines) Act 1967 (Unregistered Ships) Order 1991

The Secretary of State for Transport, in exercise of the powers conferred by section 29(2) of the Merchant Shipping (Load Lines) Act 1967(1) and now vested in him(2) and of all other powers enabling him in that behalf hereby makes the following Order:

1.—(1) This Order may be cited as the Merchant Shipping (Load Lines) Act 1967 (Unregistered Ships) Order 1991 and shall come into force on 1st January 1992.

(2) In this Order “the Act” means the Merchant Shipping (Load Lines) Act 1967.

2.—(1) For the purposes of section 29 of the Act the Secretary of State specifies the following class of ships, that is to say ships which are—

(a)British ships to which the Act applies; and

(b)not registered whether in the United Kingdom or elsewhere; and

(c)wholly owned by persons each of whom is either a citizen of the United Kingdom and Colonies or a body corporate which is established under the law of a port of the United Kingdom and has its principal place of business in a port of the United Kingdom.

(2) The Secretary of State directs that in all circumstances the provisions of the Act relating to ships registered in the United Kingdom shall have effect in relation to ships of the class specified in paragraph (1) above as if they were registered in the United Kingdom.

Explanatory Note

(This note is not part of the Order)

This Order applies the Merchant Shipping (Load Lines) Act 1967 to certain classes of unregistered British ships as if they were ships registered in the United Kingdom. This has the effect, in particular, of enabling the Secretary of State for Transport to exempt in certain cases such ships from all of the provisions of the Act and of the Merchant Shipping (Load Line) Rules 1968, or from such provisions of the Act and Rules as may be specified in a Load Line Exemption Certificate.
