The Medicines (Veterinary Drugs) (Prescription Only) (Amendment) Order 1991

Coming into force

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Scotland and in Wales, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland, and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of the powers conferred by sections 58(1) and (4), 59 and 129(4) of the Medicines Act 19681 and now vested in them2, and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following Order in accordance with section 129(6) of that Act, and after consulting and taking into account the advice of the Veterinary Products Committee in accordance with sections 58(6) and 129(7) of that Act, hereby make the following Order.

Title, commencement and interpretation1

This Order may be cited as the Medicines (Veterinary Drugs) (Prescription Only) (Amendment) Order 1991 and shall come into force on 6th December 1991.

In this Order, “the principal Order” means the Medicines (Veterinary Drugs) (Prescription Only) Order 19913.

Amendment of the principal Order2

The principal Order shall be amended in accordance with the provisions of this article.

For article 6(1) (exemptions for certain persons) there shall be substituted the following paragraph–

The restrictions imposed by section 58(2)(a) (restrictions on sale and supply) shall not apply–

a

to the sale or supply by a person listed in column 1 of Part I of Schedule 3, or

b

to the supply by a person listed in column 1 of Part II of Schedule 3,

of the prescription only medicines listed in column 2 of Part I or Part II, as the case may be, of Schedule 3 in relation to that person if and so long as the conditions specified in the corresponding paragraphs in column 3 of Part I or Part II, as the case may be, of Schedule 3 are fulfilled.

In article 10 (transitional provision) for the words “article 3(1)(e)”, in both places, there shall be substituted “article 3(1)(d)”.

In Schedule 1–

a

after the entry “Edrophonium Chloride” there shall be inserted the following entry–

Incorporation in feed as a growth promoter for –

    Piglets up to 4 months of age at levels from 4-8 ppm

  2. 2

    Pigs between 4 and 6 months of age at levels from 4-6 ppm

after the entry “Sulphapyridine Sodium” there shall be inserted, in column 1, the following two entries–

  • Sulphaquinoxaline

  • Sulphaquinoxaline Sodium

This Order amends the Medicines (Veterinary Drugs) (Prescription Only) Order 1991 so as to correct minor drafting errors in articles 6 and 10. In addition, three substances are added to Schedule 1 (descriptions and classes of prescription only medicines).
