The Child Benefit (Residence and Persons Abroad) Amendment Regulations 1992

Coming into force

The Secretary of State for Social Security, in exercise of powers conferred by sections 146(1), 147(1) and 175(1) to (4) of the Social Security Contributions and Benefits Act 19921, and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it2, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Child Benefit (Residence and Persons Abroad) Amendment Regulations 1992 and shall come into force on 28th December 1992.

Amendment of the Child Benefit (Residence and Persons Abroad) Regulations 19762

In regulation 6(1)(a) of the Child Benefit (Residence and Persons Abroad) Regulations 1976 (persons to whom Part II of those Regulations applies)3 for the words “whose employment is by or under the Crown” there shall be substituted the words “who is employed by the civil service of the United Kingdom, and is paid a salary or wages by a government department of the United Kingdom,”.

These Regulations further amend the Child Benefit (Residence and Persons Abroad) Regulations 1976 (S.I. 1976/963) (“the 1976 Regulations”).

Regulation 7 of the 1976 Regulations modifies in relation to child benefit certain presence and residence requirements in respect of certain persons who are or have been outside Great Britain. Regulation 6 of the 1976 Regulations specifies the persons, including civil servants, to whom regulation 7 applies.

Regulation 2 of these Regulations amends the definition of civil servants in regulation 6 of the 1976 Regulations.
