The Apple Orchard Grubbing Up (Amendment) Regulations 1995
Title, extent and commencement1.
These Regulations may be cited as The Apple Orchard Grubbing Up (Amendment) Regulations 1995, shall apply throughout Great Britain and shall come into force on 13th January 1995.
Amendment to the Apple Orchard Grubbing Up Regulations2.
These Regulations amend the Apple Orchard Grubbing Up Regulations 1991, by amending the definition of “the Commission Regulation” to take account of Commission Regulation (EC) No. 3149/94 (OJ No. L 332, 22.12.94, p. 29). This Commission Regulation derogates from Commission Regulation (EEC) No. 2604/90 (OJ No. L 245, 8.9.90, p. 23, amended by Commission Regulation (EC) No. 2264/94 (OJ No. L 246, 21.9.94, p. 2)), by permitting applications for the payment of premium for the grubbing up of apple orchards, payable by virtue of Council Regulation (EEC) No. 1200/90 (OJ No. L 119, 11.5.90, p. 63, last amended by Council Regulation (EC) No. 1890/94 (OJ No. L 197, 30.7.94, p. 41)), to be made during the month of January 1995.
The amendment to the Apple Orchard Grubbing Up Regulations 1991 ensures that, from the coming into force of the amendment, applications for the grubbing up premium made pursuant to the derogation set out in Commission Regulation 3149/94 will be subject to the provisions of the Apple Orchard Grubbing Up Regulations 1991.
