The Regulations contained in this Instrument are made either by virtue of, or in consequence of, provisions in the Jobseekers Act 1995 (c.18) (“the 1995 Act"). The instrument is made before the end of the period of 6 months beginning with the coming into force of those provisions; the regulations in it are therefore exempted from the requirement in section 172(1) of the Social Security Administration Act 1992 (c.5) to refer proposals to make these Regulations to the Social Security Advisory Committee and are made without reference to that Committee.

Amendment to the Social Security Benefit (Members of the Forces) Regulations168

Regulation 3 of the Social Security Benefit (Members of the Forces) Regulations 1975 F1 (unemployment benefit) shall be amended in accordance with the following provisions of this regulation.

In paragraph (1) for the words from “shall be disqualified" to the end of the paragraph there shall be substituted the words “
shall be treated for the purposes of section 19 of the Jobseekers Act 1995 F2 (circumstances in which a jobseeker’s allowance is not payable) as though he has lost his employment through misconduct.

For paragraph (2) there shall be substituted the following paragraph–

Section 19(6)(b) and (d) of the Jobseekers Act 1995 (jobseeker’s allowance not payable where claimant has voluntarily left employment or neglected to avail himself of a reasonable opportunity of employment) shall not apply to a claimant who whilst a serving member of the forces is discharged at his own request.
